Анотація: У дисертації розглянуто поняття транспортної системи, визначенокваліфікуючі ознаки та обґрунтовано твердження, що ця система є галузевоюгосподарською.Визначено категорії суб'єктів транспортної системи: суб'єктиорганізаційно-господарських повноважень і суб'єкти транспортноїдіяльності, доведено, що характер зв'язку між ними може бути предметно-функціональним або організаційно-управлінським. Наголошено, щогалузевий характер таких зв'язків забезпечує транспортна діяльність.Установлено, що правова організація транспортної системи Українихарактеризується державним регулюванням на трьох рівнях:загальнодержавному, галузевому і спеціальному галузевому. Запропонованоподіл засобів державного регулювання відносин з організації транспортноїсистеми на загальносистемні та спеціально-інституційні. Наведено поняття таознаки дозвільних транспортних процедур, констатовано, що вони можутьмати характер прямих або похідних. Запропоновано визначення та поділсертифікаційних транспортних процедур на об'єктні та суб'єктні. Спеціальнимзасобом державного регулювання визначено транспортну безпеку.. The thesis is an independent, completed scientific paper dedicated to thestudy of legal relationships that arise in connection with the formation anddevelopment of the transport system in Ukraine. It analyzes the stages offormation of the transport system in Ukraine and identifies the qualificationfeatures according to which it operates. The objective feature allowedidentifying the sectoral role of the transport system in the economy and itsfunctional direction associated with the implementation of transport activities.The subjective feature allowed identifying the categories of entities that providethe operation of the transport system and the nature of interaction between them.According to the legal feature, the transport system is considered an object oflegal regulation.The thesis proves that the transport system in Ukraine is not a subject oflaw; its sectoral operation is provided by organizational and economic entitiesand subjects of transport activity. Therefore, it is proposed to identify thesubjects of transport infrastructure (transport infrastructure operators)separately.The legal nature of transport activity as a type of economic activity isidentified by delimitation of general (generic) and special (sectoral) features. Itis proved that the implementation of transport activities, just as the operation ofthe transport system in general, is always connected with the use of transportinfrastructure. The thesis concludes on the formation of an institution ofinfrastructural law in Ukraine, its role and place in the legislation governing thetransport system.
