Анотація: У роботі досліджено адміністративно-правовий аспект права на мирні зібрання, його місце в системі прав людини і громадянина, сутнісніхарактеристики, дефініція. Проведено періодизацію становлення права на мирні зібрання в Україні. Проаналізовано особливості зарубіжного досвіду у сфері забезпечення реалізації та захисту права на мирні зібрання на прикладі ФРН, США та РФ. Визначено поняття та структурні елементи адміністративно-правового механізму забезпечення реалізації та захисту права на мирні зібрання.Аргументовано необхідність прийняття спеціального закону щодо мирних зібрань. Сформульовано пропозиції щодо змісту такого закону.. The dissertation is an independent completed scientific work devoted to the study of administrative and legal guarantee of the right to peaceful assembly in Ukraine.The subject of the study is the public relations that arise in the process of exercise and enforcement of the right to peaceful assembly. The paper formulates the scientific novelty of the results of the dissertation research, which is determined by the fact that the dissertation is one of the first special comprehensive study of the administrative and legal principles of guarantee the right to peaceful assembly in the science of administrative law. As a result of the research, new scientific provisions and conclusions, proposed by the dissertation student personally, have been formulated. The peculiarities of the administrative and legal mechanism for ensuring theimplementation and protection of the right to peaceful assembly, shortcomings and ways of improvement are examined in order to ensure strict observance of the rightto peaceful assembly in accordance with the requirements of European standards in the field of human rights and the Constitution of Ukraine. Improvement of legal regulation in the sphere of guarantee the right to peaceful assembly is proposed. The author proposes original definition of the concepts: «administrative andlegal guarantee of the right to peaceful assembly», «right to peaceful assembly», «peaceful assembly», «administrative and legal mechanism for ensuring the implementation and protection of the right to peaceful assembly in Ukraine». The basic principles in the field of guarantee the right to peaceful assembly are summarized on the basis of an analysis of the fundamental decisions of the European Court of Human Rights in cases of freedom of peaceful assembly. The formation and development of the right to peaceful assembly in Ukraine is periodized.
