In Legal Pragmatism, Michael Sullivan looks closely at the place of the individual and community in democratic society. After mapping out a brief history of American legal thinking regarding rights, from communitarianism to liberalism, Sullivan gives a rich and nuanced account of how pragmatism worked to resolve conflicts of self-interest and community well-being. Sullivan's view of pragmatism provides a comprehensive framework for understanding democracy, as well as issues such as health care, education, gay marriage, and illegal immigration that will determine its character in the future. Legal Pragmatism is a bold, carefully argued book that presents a unique understanding of contemporary society, law, and politics.

What would the Framers of the Constitution make of multinational corporations? Nuclear weapons? Gay marriage? They led a preindustrial country, much of it dependent on slave labor, huddled on the Atlantic seaboard. The Founders saw society as essentially hierarchical, led naturally by landed gentry like themselves. Yet we still obey their commands, two centuries and one civil war later. According to Louis Michael Seidman, it's time to stop. In On Constitutional Disobedience, Seidman argues that, in order to bring our basic law up to date, it needs benign neglect. This is a highly controversial assertion. The doctrine of "original intent" may be found on the far right, but the entire political spectrum--left and right--shares a deep reverence for the Constitution. And yet, Seidman reminds us, disobedience is the original intent of the Constitution. The Philadelphia convention had gathered to amend the Articles of Confederation, not toss them out and start afresh. The "living Constitution" school tries to bridge the gap between the framers and ourselves by reinterpreting the text in light of modern society's demands. But this attempt is doomed, Seidman argues. One might stretch "due process of law" to protect an act of same-sex sodomy, yet a loyal-but-contemporary reading cannot erase the fact that the Constitution allows a candidate who lost the popular election to be seated as president. And that is only one of the gross violations of popular will enshrined in the document. Seidman systematically addresses and refutes the arguments in favor of Constitutional fealty, proposing instead that it be treated as inspiration, not a set of commands. The Constitution is, at its best, a piece of poetry to liberty and self-government. If we treat it as such, the author argues, we will make better progress in achieving both.

Framed by a general discussion of the history of the separation between church and state and through careful attention to subjects such as capital punishment, gay marriage, and clergy support of political leaders, there emerges an incredibly complex, enlightening, and provocative picture for anyone with an interest in the unique nature of religion in the United States of America.

Much has been written on how masculinity shapes international relations, but little feminist scholarship has focused on how international relations shape masculinity. Charlotte Hooper draws from feminist theory to provide an account of the relationship between masculinity and power. She explores how the theory and practice of international relations produces and sustains masculine identities and masculine rivalries. This volume asserts that international politics shapes multiple masculinities rather than one static masculinity, positing an interplay between a "hegemonic masculinity" (associated with elite, western male power) and other subordinated, feminized masculinities (typically associated with poor men, nonwestern men, men of color, and/or gay men). Employing feminist analyses to confront gender-biased stereotyping in various fields of international political theory -- including academic scholarship, journals, and popular literature like The Economist -- Hooper reconstructs the nexus of international relations and gender politics during this age of globalization.

This book represents (to me at least) a significant culmination in my work as an art historian over a thirty-year period and some of the people who have in various ways supported me – knowingly or not – might be surprised to see their names mentioned here. An ever-increasing number of them, depressingly, are also deceased and their mention is partly offered here as a sign that the books and essays they produced were important to me and might be consulted by anyone who values my contribution and wants to investigate its relationship to work by the writers and scholars who have influenced me.
