Despite the vast differences between the Right and the Left over the role of education in the production of inequality one common element both sides share is a sense that education can and should do something about society, to either restore what is being lost or radically alter what is there now. The question was perhaps put most succinctly by the radical educator George Counts in 1932 when he asked "Dare the School Build a New Social Order?", challenging entire generations of educators to participate in, actually to lead, the reconstruction of society. Over 70 years later, celebrated educator, author and activist Michael Apple revisits Counts’ now iconic works, compares them to the equally powerful voices of minoritized people, and again asks the seemingly simply question of whether education truly has the power to change society. In this groundbreaking work, Apple pushes educators toward a more substantial understanding of what schools do and what we can do to challenge the relations of dominance and subordination in the larger society. This book defines and explains the operation of the defense of change of position in Anglo-Australian law. It is a widely accepted view that the defense is a modern development, the first express recognition of which can be traced in England to the seminal decision of the House of Lords in Lipkin Gorman (a firm) v Karpnale Ltd. This work takes a different stance, arguing that the modern case law is best understood through an examination of its historical antecedents, placing the defense within its broader historical context and showing how its disputed features might be resolved. Part One of the book considers other, well-established defenses, shedding light on the change of position defense and laying the foundations for the examination of the defense in a manner consistent with the law as a whole, which is the task of Part Two of the book. In Part Two, the features of the defense are identified, examined, and clarified by reference to the change of position defense authorities, considerations of policy and principle and the lessons derived from the doctrines and defenses which were the subject of Part One.

This book grew out of a conference organized by the German Historical Institute (GHI) on May 23-5, 1996, iii Berlin. For three days, thirty-five scholars from n\ne countries became acht-und-sechziger (sixty-eighters), not on the streets and barricades but in lively debate over the events and significance of the momentous year 1968. This book consists of revised versions of many of the original papers as well as entirely new essays that complement our overall theme. I thank all of the authors and also those who participated in the conference but whose work could not be included here. I am grateful to Carl-Ludwig Holtfrerich (Free University Berlin), Luisa Passerini (European University Institute, Florence), Keith A. Reader (University of Newcastle), and Dieter Rucht (Wissenschaftszentrum Berlin) for chairing the various sessions and for guiding us through spirited discussions. The topic of this book dovetails nicely with the efforts of the GHI in Washington to promote comparative research. In fact, most of the four to five international conferences the Institute rganizes annually are based on this perspective, comparing events, ideas, and structures in the United States and Europe. At times we have even taken a global perspective, with 1968: The World Traniformed being a case in point. In this age of globalization, historians should also become global players - at least mentally.

This book examines the doctrine of transgenerational punishment found in the Decalogue-that is, the idea that God punishes sinners vicariously and extends the punishment due them to three or four generations of their progeny. Though it was "God-given" law, the unfairness of punishing innocent people merely for being the children or grandchildren of wrongdoers was clearly recognized in ancient Israel. A series of inner-biblical and post-biblical responses to the rule demonstrates that later writers were able to criticize, reject, and replace this problematic doctrine with the alternative notion of individual retribution. From this perspective, the formative canon is the source of its own renewal: it fosters critical reflection upon the textual tradition and sponsors intellectual freedom. To support further study, this book includes a valuable bibliographical essay on the distinctive approach of inner-biblical exegesis showing the contributions of European, Israeli, and North American scholars. The Beauty Bias explores the social, biological, market, and media forces that have contributed to appearance-related problems, as well as feminism's difficulties in confronting them. The book also reviews why it matters. Appearance-related bias infringes fundamental rights, compromises merit principles, reinforces debilitating stereotypes, and compounds the disadvantages of race, class, and gender. Yet only one state and a half dozen localities explicitly prohibit such discrimination. The Beauty Bias provides the first systematic survey of how appearance laws work in practice, and a compelling argument for extending their reach. The book offers case histories of invidious discrimination and a plausible legal and political strategy for addressing them. Our prejudices run deep, but we can do far more to promote realistic and healthy images of attractiveness, and to reduce the price of their pursuit.
